Consumer Law – Ireland – Enforcement Action

The National Consumer Agency (NCA) has recently published the latest edition of the Consumer Protection List. The List which is published at regularly intervals sets out the enforcement action that NCA officials have taken during a specified period of time. The current List, covering the period between January and June 2013, records that during that time 54 enforcement actions were taken against businesses throughout Ireland.

As with previous Consumer Protection Lists, the majority of non-compliances on the current List relate to misleading prices and the failure to display prices. The enforcement actions can be broken down as follows:

  • Six Undertakings from domestic waste operators to change contract terms and conditions;
  • One conviction of a car dealer in relation to the sale of a clocked car;
  • One Undertaking from a car dealer in relation to the sale of a clocked car; and
  • 46 Enforcement Actions against traders in relation breaches of misleading pricing and price display legislation
